Chile: alimony debts may be collected from AFP funds

What is the regulation?

The law establishes a special procedure in the collection of alimony pensions, since it will guarantee that the collection process can be “carried out with criteria of justice and dignity” where the financial history of debtors can be observed, as announced by the presidency From Chile.

How does this new law work?

As soon as there is a record of any pending monthly payment, the mother or guardian of the minor may request a court to order the search for the debtor’s assets in three ways: withholding the funds presented in a bank account, financial and investment instruments, or in voluntary pension savings accounts.

Now, if you are in the worst case scenario, where three monthly alimony payments have been accumulated, either total or partial, and the debtor does not have sufficient funds to assume his responsibility, the court will order the payment through the resources available from the mandatory pension contributions managed by Chile’s private fund administrators (AFPs).

Up to what age can my child receive the pension?

It should be noted that, in the South American country, children have the right to receive alimony until they are 21 years old or until they are 28, when they are studying higher education and it is obtained by the father or mother who is absent in their upbringing.
